Terms of Service

These Terms of Service ("Terms") govern your access to and use of the GAFFER football coaching game, website at gaffer.house, and related services (collectively, the "Services") operated by Max Potential Sportif Yatırımlar Anonim Şirketi("Max Potential," "we," "us," "our").

By accessing or using the Services, you agree to be bound by these Terms. If you do not agree, please do not use the Services. These Terms incorporate by reference our Privacy Policy.

1. What GAFFER Is

GAFFER is an entertainment platform— a football coaching simulation game. While watching live matches, you make tactical decisions (substitutions, formations, tactics) and predictions, which are compared to the real manager's choices. Your decisions earn Gaffer Points (GP) — virtual in-game credits with no monetary value.

• GAFFER is not a betting or gambling service. No real money can be won or lost. GP cannot be exchanged for cash, prizes, or any goods.
• GAFFER is not affiliated with any football club, national federation, league, UEFA, FIFA, or any governing body.
• GAFFER is not a football data reseller. Live data is used solely to power the game experience for registered users.

2. Eligibility and Accounts

2.1 Age Requirement

You must be at least 18 years old to use GAFFER. By creating an account you confirm that you meet this requirement. We do not knowingly collect data from persons under 18. If we discover an account was created by a minor, we will close it.

2.2 Account Registration

A valid email address is required to create an account. You may register via Google OAuth or email. You are responsible for:

• Providing accurate registration information;
• Keeping your credentials confidential;
• All activity that occurs under your account.

Notify us immediately at legal@gaffer.house if you suspect unauthorised access. One person may hold one account; duplicate accounts created to circumvent restrictions are prohibited.

2.3 Account Termination by You

You may delete your account at any time from Settings → Privacy. Deletion is permanent — your GP, badges, and coaching history cannot be recovered.

3. Subscriptions and Payments

3.1 Free Tier

GAFFER offers a permanent free tier with up to 3 coaching decisions per match and access to core features as described on our pricing page.

3.2 Gaffer Pro

Gaffer Pro is a paid subscription (monthly or annual) that unlocks additional features. Current pricing is shown at gaffer.house/pricing. We may change pricing with reasonable advance notice.

3.3 Payment Processing

Payments are processed by Paddle.com Market Limited("Paddle"), our Merchant of Record. Paddle handles billing, VAT, and all applicable taxes. Your payment card details are managed by Paddle — we never store full card numbers on our servers. Paddle's privacy policy and terms apply to transactions.

3.4 Auto-Renewal and Cancellation

Subscriptions auto-renew at the end of each billing period until cancelled. You may cancel at any time via the Paddle billing portal (accessible from Settings → Billing). Cancellation takes effect at the end of the current billing period; access is retained until that date.

3.5 Refunds

See our Refund Policy for full details. In summary: direct web subscribers may request a refund within 14 calendar days of initial purchase, provided paid features have not been substantially used. Where mandatory consumer law grants a withdrawal right, that right applies.

4. Gaffer Points, Scores and Leaderboards

Gaffer Points (GP) are virtual in-game credits only. They:

• have no monetary value and cannot be exchanged for money, prizes, or goods;
• are calculated automatically using our scoring algorithm based on alignment with the manager's decision, timing, and match impact;
• may be adjusted, reset, or recalculated if errors are discovered;
• are subject to decay over time on the all-time leaderboard (older sessions contribute less) — see How GAFFER Works for details.

Leaderboard rankings are provided for entertainment purposes only. We reserve the right to modify, suspend, or reset scoring mechanics, leaderboards, or badges at any time.

5. Acceptable Use

You agree not to, and not to attempt to:

• Use bots, scripts, automation, or any artificial means to submit decisions, earn GP, or manipulate game mechanics, scores, or leaderboards;
• Create multiple accounts to circumvent free-tier limits, bans, or other restrictions;
• Access or interfere with another user's account or data;
• Use the Services for unlawful purposes or in violation of any applicable law or regulation;
• Reverse-engineer, decompile, or extract source code from the Services;
• Scrape, harvest, or systematically collect data from the Services without permission;
• Post or transmit harmful, abusive, defamatory, or misleading content via any community features we may offer;
• Attempt to probe, scan, or test the vulnerability of any system or network associated with the Services.

Violation may result in suspension or permanent termination of your account, including forfeiture of any GP balance, badges, or Gaffer Pro access.

6. License

Subject to your compliance with these Terms, Max Potential grants you a limited, non-exclusive, non-sublicensable, revocable, non-transferable license to access and use the Services for your personal, non-commercial entertainment. All rights not expressly granted are reserved.

7. Intellectual Property

The GAFFER name, logo, software, game design, scoring algorithms, visual elements, and all other content are owned by or licensed to Max Potential and protected by copyright, trademark, and other intellectual property laws. You may not copy, distribute, publicly display, or commercially exploit any part of the Services without our prior written consent.

Football data used to power the game is sourced from licensed third-party data providers. All club names, crests, and competition names are the intellectual property of their respective owners.

8. Third-Party Services

The Services integrate with or link to third-party services (e.g., Google OAuth, Paddle, analytics providers, football data APIs). We do not control these services and their own terms and privacy policies may apply. We are not responsible for third-party content or practices.

9. Availability; Changes to the Services

We do not guarantee that the Services will always be available, uninterrupted, timely, or error-free. We may modify, suspend, or discontinue any feature or the Services as a whole at any time with or without notice, including changes to scoring rules, GP mechanics, badge criteria, or subscription benefits.

Where a material reduction in paid features occurs mid-subscription, we will endeavour to provide reasonable advance notice and a pro-rated refund option where required by applicable law.

10. Disclaimers; Limitation of Liability

10.1 Disclaimer

The Services are provided on an "as is" and "as available" basis. To the maximum extent permitted by applicable law, Max Potential disclaims all warranties, express or implied, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that scoring outcomes, match data, or game results will be accurate, complete, or error-free.

10.2 Limitation of Liability

To the maximum extent permitted by applicable law, Max Potential shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or related to your use of (or inability to use) the Services, including loss of GP, badges, game progress, or subscription access. In no event shall our total aggregate liability exceed the amount you paid to Max Potential in the twelve (12) months preceding the event giving rise to the claim, or €50, whichever is greater.

Nothing in these Terms limits liability that cannot be excluded or limited under applicable mandatory consumer protection law (including under Turkish Consumer Protection Law No. 6502 or equivalent EU/UK law).

10.3 Indemnity

You agree to indemnify and hold harmless Max Potential, its directors, employees, and agents from any claims, damages, or costs (including reasonable legal fees) arising from: (i) your use of the Services; (ii) your breach of these Terms; or (iii) your violation of any law or third-party rights.

11. Suspension and Termination

We may suspend or terminate your account at any time if you violate these Terms or if required for security, legal, or operational reasons. Upon termination, your licence to use the Services ends immediately. GP, badges, and game history associated with a terminated account will be forfeited.

You may close your account at any time via Settings → Privacy → Delete Account.

12. Dispute Resolution; Governing Law

These Terms are governed by the laws of the Republic of Türkiye, without regard to conflict of law principles.

Unless otherwise required by mandatory applicable law, disputes arising out of or related to these Terms or the Services shall be subject to the exclusive jurisdiction of the Istanbul (Çağlayan) Courts and Enforcement Offices.

If you are a consumer, you may also apply to consumer arbitration boards (Tüketici Hakem Heyeti) or consumer courts under Turkish Consumer Protection Law No. 6502, or equivalent consumer dispute bodies in your country of residence where mandatory local law applies.

13. Changes to These Terms

We may update these Terms from time to time. Material changes will be communicated via email or a notice within the Services at least 14 days before taking effect. Your continued use after the effective date constitutes acceptance of the updated Terms.

14. General

• Entire agreement. These Terms (together with the Privacy Policy and Refund Policy) constitute the entire agreement between you and Max Potential regarding the Services.
• Severability. If any provision is found unenforceable, the remaining provisions remain in full force.
• No waiver. Failure to enforce any provision is not a waiver of our right to enforce it later.
• Assignment. You may not assign your rights or obligations under these Terms without our consent. We may assign ours in connection with a corporate transaction.
